Can a Digital Influencer be Penalized for Promoting Services and Products?
Digital Influencers do not have legislation specifically directed at them, however, they have a commitment and obligation to the consumer, always required to act in good faith and with transparency.
It is important to highlight that if the elements and references are not coherent and cause harm to consumers, the Influencer will be held civilly liable.
In the Consumer Protection Code, there is joint responsibility for all those involved in the sale, brand promotion, and product display, therefore, all can be held accountable for misleading advertising!
Digital Influencers have a vast channel of communication, hence, they must act responsibly and transparently.
